Risk of Loss
Tire Buyer takes full responsibility and assumes all risk of loss for all tire products purchased from the time a American Tire Management INC. DBA ATM Tire Recycling Inc. registered dealer has accepted, received and invoiced their used tire order through the used tire order processes available. Tire Buyer acknowledges and accepts the purchasing terms and conditions in that all used tire purchases are consider "Finale without Recourse for Refund and/or Return", "As Is" bases and without "Product Warranty". Invoiced shipping, delivery, transportation and export charges and/or fees are a separate itemized service on the invoice that the buyer takes full expenditure responsibility for and assumes all risk of loss for all used tire products associated with the service. Tire Buyer assures reception of delivery and/or shipment that was invoiced and takes full expenditure responsibility for any used tire shipment and/or used tire purchase that is stopped and/or returned associated with the invoice, to include active storage fees imposed daily.

Import/Export Issues
It is the responsibility of the tire buyer to comply with customs import procedures applicable to foreign guideline with concerns to used tires unless ATMTireRecycling.com has been hired to conduct the export quote. Customs inspection, import fees and proof of sale compliance may be required to complete a import/export purchase.


Used Tire Condition and History Disclaimer.
ALL USED TIRES ARE SOLD "AS-IS WHERE-IS"
All used tires sold through ATMTireRecycling.com are sold "AS-IS WHERE-IS", WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY.
ATMTireRecycling.com and its affiliated tire dealers expressly disclaim the accuracy or completeness of any and all information provided to Tire Buyers regarding used tires, whether provided in written, verbal, or digital image form ("Used Tire Information"). Used Tire Information provided by ATMTireRecycling.com and its affiliated tire dealers is for convenience only. Tire Buyers shall not rely on Used Tire Information in deciding whether or how much to pay on a used tire offered for sale through ATMTireRecycling.com. Tire buyers acknowledges all used tires sold by American Tire Management Inc. DBA ATM Tire Recycling are subject to an accepted industry wide scrap percentage of 5% or less per used tire load sold.

Certain jurisdictions permit used tires to be sold without verification and/or inspection, and as a result ATMTireRecycling.com and its affiliated tire dealers does not guarantee that used tires are able to pass local and/or general inspections. ATMTireRecycling.com and its affiliated tire dealers do not guarantee that used tires meet or can be modified to meet local guidelines and/or safety requirements. It is the sole responsibility of Tire Buyer to ascertain, confirm, research, inspect, and/or investigate used tires and any and all information regarding the type, condition, status, and history of used tires prior to purchasing them.

Registration Laws Disclaimer
ATMTireRecycling.com and its affiliated tire dealers do not guarantee that any used tire sold can be legally used in any state or country, and Tire Buyer accepts all risks associated with variations in used tires and registration laws between states, provinces, and countries that may negatively impact the marketability of used tires purchased through ATMTireRecycling.com's website
C. DMV/DOT Paperwork Disclaimers. ATMTireRecycling.com and its affiliated tire dealers are not responsible for defects, errors, or omissions (i) related to used tire department paperwork not processed by ATMTireRecycling.com and its affiliated tire dealers, or (ii) made by DMV/DOT.

LOCAL LAWS; EXPORT/IMPORT CONTROL
ATMTireRecycling.com and its tire affiliates controls and operates this Site from its headquarters in Raleigh, North Carolina of the United States of America and makes no representation that the materials are appropriate or will be available for use in other locations. Unless otherwise explicitly stated, all marketing or promotional materials found on this Site are solely directed to individuals, companies or other entities located in the United States. If you use this Site from outside the United States of America, you are entirely responsible for compliance with applicable local laws, including but not limited to the export and import regulations.

APPLICABLE LAW AND CHOICE OF FORUM

IF ANY PROVISION OF THIS AGREEMENT IS HELD TO BE INVALID OR UNENFORCEABLE, SUCH PROVISION SHALL BE STRUCK AND THE REMAINING PROVISIONS SHALL BE ENFORCED. YOU AGREE THAT THIS AGREEMENT AND ALL INCORPORATED AGREEMENTS MAY BE AUTOMATICALLY ASSIGNED BY ATMTIRERECYCLING.COM AND ITS TIRE AFFILIATES.
